  • Posting Optimization: AI determines optimal posting times and frequency

AI Processing Consent:

  • You consent to AI processing of your content, social media data, and usage patterns
  • AI models may learn from aggregated, anonymized user data to improve performance
  • You retain ownership of content you create, but grant us license to process it for AI improvements
  • We may use third-party AI services (Google Gemini, OpenAI, etc.) subject to their terms

AI-Generated Content Responsibility:

  • You are responsible for reviewing all AI-generated content before publishing
  • AI suggestions are provided as-is and may not always be accurate or appropriate
  • You must ensure AI-generated content complies with platform policies and applicable laws
  • We are not liable for consequences arising from use of AI-generated content

5. Social Media Platform Integration

Content Publishing:

  • All content must comply with each platform's community guidelines and terms
  • You are solely responsible for content published through Shocify
  • Some platforms may have posting limits or require manual approval
  • Failed posts due to platform restrictions are not our responsibility

6. User Conduct and Prohibited Activities

Acceptable Use:

  • Use Shocify only for legitimate social media management purposes
  • Respect the rights and privacy of other users and third parties

  • Maintain professional and respectful communication

Prohibited Content: You may not create, upload, or distribute content that:

  • Interfering with the platform's operation or other users' experience
  • Creating multiple accounts to circumvent restrictions
  • Selling, transferring, or sharing your account access

Enforcement:

  • We may investigate suspected violations and take appropriate action
  • Violations may result in warnings, feature restrictions, or account termination
  • Repeated violations may result in permanent platform bans

7. Premium Services and Billing

Shocify offers both free and premium subscription tiers:

Billing and Payment:

  • Premium subscriptions are billed in advance on a monthly or annual basis
  • All fees are in USD and include applicable taxes where required
  • Payment is due immediately upon subscription activation
  • We use secure third-party payment processors
  • Failed payments may result in service suspension

Cancellation and Refunds:

  • You may cancel your subscription at any time through your account settings
  • Cancellation takes effect at the end of your current billing period
  • No refunds are provided for partial billing periods

  • You are responsible for ensuring you have rights to all content you upload
  • You may export your content at any time

DMCA Compliance:

  • We comply with the Digital Millennium Copyright Act (DMCA)
  • Copyright holders may submit takedown notices
  • Users may submit counter-notices for disputed claims
  • Repeat infringers may have their accounts terminated

9. Privacy and Data Protection

  • Implied warranties of merchantability, fitness for a particular purpose, and non-infringement
  • Warranties regarding accuracy, reliability, or completeness of Shocify
  • Warranties that Shocify will be uninterrupted, secure, or error-free
  • Warranties regarding the quality or accuracy of AI-generated content

Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, 618MEDIA'S LIABILITY IS LIMITED AS FOLLOWS:

Exclusions: We are not liable for:

  • Indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, revenue, data, or business opportunities
  • AI-generated content that violates platform policies or laws
  • Failed social media posts due to third-party platform issues
  • Social media account suspensions or bans

Liability Cap:

  • Our total liability will not exceed the amount you paid for Shocify in the 12 months preceding the claim
  • For free accounts, our liability is limited to $100 USD

Exceptions: This limitation does not apply to death or personal injury caused by our negligence, fraud, gross negligence, or any liability that cannot be excluded by applicable law.

12. Termination

Termination by You:

  • You may terminate your account at any time through your account settings
  • Cancellation of premium subscriptions follows our billing terms
  • You may request data export before account deletion

Termination by Us:

  • We may terminate accounts for violations of these Terms
  • Immediate termination may occur for serious violations
  • We generally provide notice before termination unless legally prohibited

Effect of Termination:

  • Your license to use Shocify immediately ends
  • Connected social media accounts remain under your control
  • Most personal data is deleted within 30 days
  • Some data may be retained for legal compliance
